Plugin terms

1. Introduction

These Plugin Terms apply to all plugins offered by Sky Dust on the platform skydust.app (“we,” “us,” “our”) and to any plugins created by users (“user-generated plugins”). These plugins are designed to help users comply with the Corporate Sustainability Reporting Directive (CSRD), European Sustainability Reporting Standards (ESRS), and ensure the responsible use of Artificial Intelligence (AI). These Terms include our Usage Policies and other documentation, guidelines, or policies we may provide in writing or on our website By using or creating plugins, you (“the user”) agree to these terms. 2. Scope of Plugins

  • Sky Dust Plugins: Our plugins are tools that can retrieve and share information or take actions within your digital applications, such as websites or apps. They are specifically designed to assist in compliance with CSRD and ESRS regulations and promote responsible AI usage.
  • User-Generated Plugins: Users may create their own plugins for use within their applications. These plugins must comply with the same regulations and ethical guidelines as Sky Dust plugins. User-generated plugins can retrieve and share information or take actions within digital applications, but the user is responsible for their development, functionality, and compliance with applicable laws.


3. User Responsibilities

  • Appropriate Use: Whether using Sky Dust plugins or user-generated plugins, you agree to use them only for their intended purpose and in a manner that complies with all applicable laws and regulations, including CSRD, ESRS, and data protection laws.
  • Integration: You are responsible for correctly integrating both Sky Dust plugins and user-generated plugins into your applications. We provide documentation for Sky Dust plugins, but the final responsibility for integration and functionality of user-generated plugins lies with you.
  • Data Accuracy: Any data retrieved or shared using our plugins or user-generated plugins should be accurate and relevant. You are responsible for verifying the accuracy of the data before using it for decision-making or reporting purposes.


4. Data Handling and Privacy

  • Data Processing: Both Sky Dust plugins and user-generated plugins may process and transmit data as part of their functionality. We ensure that Sky Dust plugins comply with the General Data Protection Regulation (GDPR) and other relevant data protection laws. You are responsible for ensuring that user-generated plugins comply with these regulations as well.
  • Data Privacy: We do not store any personal data processed by the plugins on our servers, unless explicitly stated otherwise. All data processing occurs within your application environment, and you are responsible for ensuring that your use of the plugins, including user-generated plugins, complies with applicable privacy laws.
  • Third-Party Services: If plugins, whether Sky Dust or user-generated, interact with third-party services, we do not take responsibility for how these services handle your data. You should review the privacy policies of any third-party services you use in conjunction with our plugins or your own plugins.


5. Intellectual Property

  • Sky Dust Plugins: All intellectual property rights in Sky Dust plugins, including software code, documentation, and related materials, belong to Sky Dust. You are granted a non-exclusive, non-transferable license to use these plugins in accordance with these terms.
  • User-Generated Plugins: You retain ownership of the intellectual property rights in the plugins you create. However, by creating and using these plugins on the Sky Dust platform, you grant Sky Dust a non-exclusive, royalty-free, worldwide license to use, distribute, modify, and publicly display your plugins as necessary to provide and promote our services.
  • Restrictions: You may not reverse-engineer, decompile, or modify Sky Dust plugins. Similarly, Sky Dust reserves the right to review and, if necessary, restrict the use of user-generated plugins that do not comply with our terms or legal requirements.


6. Liability and Security

  • Limitation of Liability: Our liability for any claims arising out of or in connection with the use of our plugins or user-generated plugins is limited to the amount you have paid for the service. We are not liable for any indirect, incidental, or consequential damages.
  • Security: We take reasonable measures to ensure that our plugins are secure and free from vulnerabilities. However, we cannot guarantee that the plugins, whether Sky Dust or user-generated, will be completely secure or error-free. You are responsible for maintaining the security of your application environment and for ensuring that user-generated plugins meet security standards.
  • No Guarantee: While we strive to provide reliable and effective plugins, we do not guarantee any specific outcomes from their use. Compliance with CSRD, ESRS, and AI guidelines remains your responsibility.
  • Export controls: You represent and warrant that you and your Plugins are not (a) located in, under the control of, or a national or resident of any country embargoed by the European Union or one of its member states, and (b) listed on any European sanctioned party list. You will comply with applicable European or national control laws and regulations.


7. Updates and Changes

  • Plugin Updates: We may update Sky Dust plugins from time to time to improve functionality, address security issues, or comply with legal requirements. You are responsible for implementing these updates in your applications. For user-generated plugins, you are responsible for maintaining and updating them to ensure continued compliance and functionality.
  • Changes to Terms: We reserve the right to update these Plugin Terms periodically. Any changes will be communicated to you in writing and will apply to future use of both Sky Dust plugins and user-generated plugins.


8. Dispute Resolution and Governing Law

  • Disputes: If you have any disputes regarding the use of our plugins or user-generated plugins, please contact us first to resolve the issue amicably. If the dispute cannot be resolved, it will be referred to mediation or arbitration in accordance with European law.
  • Governing Law: These Plugin Terms are governed by the laws of the European Union and your local country. The courts of your country of residence will have jurisdiction in case of a legal dispute.


9. Termination

These Terms take effect when you first create your Plugin and remain in effect until terminated. You or we can terminate these Terms by removing your Plugin from the Sky Dust platform for any reason by providing at least 30 days’ advance notice to the other party, except you can terminate the Terms immediately with notice to us if you determine that our use of your Plugin exposes you, your users, or others to risk of liability or harm. We may suspend or terminate these Terms immediately if you materially breach these terms, we determine that your Plugin exposes us or anyone else to risk of liability or harm, or to comply with law or government requests.
